1. What these terms cover

Casting Scotland Marketplace lets independent productions create and manage casting briefs and receive applications. These terms apply to a production account, its users, casting briefs and use of applicant information.

The Marketplace is not an employment agency, talent agent, employer, producer, guarantor or party to an engagement between a production and an applicant. Casting Scotland Platform is separate. A Marketplace production account does not create a Platform production account or give access to Platform briefs or represented talent.

2. Authority and account security

You confirm that you are authorised to act for the named production, company, college, university or other organisation. You must provide accurate account, contact and project information, protect login credentials and promptly tell us about unauthorised use. You are responsible for activity through your account and for ensuring colleagues who access it comply with these terms.

3. Listings and moderation

Each brief must be for a genuine, specific independent creative opportunity. It must accurately state the project title and type, production contact and organisation, role details, playing age, location, dates, payment or expenses, deadline and material requirements or content.

You must not post misleading, discriminatory, exploitative, unsafe, illegal, sexually explicit or otherwise inappropriate content; requests for upfront payments from talent; general talent harvesting; deceptive representation offers; or work with no genuine casting purpose.

We may review, edit for clarity, ask for evidence or further information, pause, reject, remove or close a listing or account where reasonably necessary for quality, safety, compliance or user protection. Publication is not guaranteed and does not endorse a production.

4. Payment, expenses and engagement terms

You are solely responsible for making truthful statements about pay, expenses, travel, accommodation, cancellation, contracts, releases, tax, employment status, working conditions and intellectual-property rights. You must honour the terms you offer, subject to any lawful variation agreed directly with the performer.

You must not describe a role as paid if no payment is intended, or omit material costs or conditions. You must determine whether an unpaid or volunteer opportunity is lawful for your production and location.

5. Safeguarding and under-18s

You are responsible for safeguarding and for complying with all applicable law and guidance, including child performance licences, parental or guardian consent, chaperones, working hours, welfare, risk assessment and any DBS/PVG or other checks required for your circumstances.

Do not invite, audition, engage or communicate with an under-18 through the Marketplace unless you have appropriate safeguarding procedures and all required approvals. Casting Scotland does not verify licences, supervise auditions or act as a chaperone.

6. Applicant data and communications

Applicants’ names, contact details, images, profile details and application notes are personal data. You may use them only to assess, administer and communicate about the relevant casting opportunity, comply with legal obligations, or for another purpose clearly permitted by applicable data-protection law.

You must keep applicant data secure, restrict access to authorised team members, not sell, publish, scrape, reuse or add it to mailing lists, and delete or anonymise it when no longer needed. Keep communication professional, relevant and respectful.

7. Your content and rights

You confirm that you have the right to upload all artwork, project information, scripts, sides, logos and other material you provide. You give Casting Scotland a limited, non-exclusive licence to host, reproduce and display that material solely to operate, promote and administer the relevant Marketplace listing.

8. Reports, suspension and liability

You must cooperate reasonably with a safety or moderation enquiry. We may preserve relevant records, restrict an account or remove a listing while an enquiry is considered. Serious concerns may be referred to the appropriate authority where required or justified by law.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that, Casting Scotland is responsible for providing the Marketplace with reasonable care and skill. We are not responsible for casting decisions, applicant conduct, production conduct, payments, contracts or disputes between a production and an applicant, except where caused by our own failure to meet that standard.

9. Changes, contact and law

We may update these terms where necessary for legal, safety, service or operational reasons. For material changes, we will give reasonable notice through the Marketplace or by email. Questions, concerns or complaints: castings@castingscotland.co.uk.

These terms are governed by Scots law. Courts with jurisdiction under applicable law may hear a dispute.
